FuxionVideo Terms of Use

1. Acceptance and service

These Terms govern your access to FuxionVideo, an audiovisual creation service operated by AlienCat Software. By creating an account, purchasing credits or a subscription, or using the service, you agree to these Terms. If you do not agree, do not use the service.

2. Accounts and security

You must provide accurate information, protect your credentials, and promptly notify us of unauthorized use. You are responsible for activity performed through your account. You may not share, sell, or misuse accounts or evade usage limits.

3. Your content and the processing license

You retain whatever rights you legally hold in prompts, scripts, images, video, audio, logos, trademarks, voices, and other material you upload or submit (“User Content”). You grant us a limited, worldwide, non-exclusive, royalty-free license to host, copy, transmit, process, modify, and display User Content solely as needed to operate, secure, support, and improve the service and to produce the output you request, including through our infrastructure and third-party providers.

We do not use private User Content or generated output in advertising, public galleries, case studies, social posts, or other promotions unless you give separate affirmative permission or deliberately submit that output to a clearly labeled public showcase or promotional program.

If you opt in, you grant AlienCat Software a non-exclusive, worldwide, royalty-free license to reproduce, edit, adapt, publish, display, distribute, and publicly perform only the selected generated output for FuxionVideo and AlienCat Software marketing. Unless separately authorized, this license excludes private source files, confidential information, and use of your name, voice, likeness, or logos. You may withdraw consent for future uses; withdrawal does not require recall of materials already lawfully published, subject to applicable law. No compensation is owed unless separately agreed in writing.

4. Copyright, likenesses, music, and other rights

You are solely responsible for User Content, generated output, and how you publish or use it. You represent that you have all necessary rights, licenses, releases, and permissions for every person, image, clip, recording, song, logo, brand, voice, likeness, and other element you submit or use. You may not infringe copyright, trademark, privacy, publicity, contractual, or other rights.

FuxionVideo does not perform legal clearance, copyright searches, fact-checking, or professional review of your content. We do not guarantee that output is unique, eligible for copyright protection, accurate, or non-infringing. You must review each output before using or publishing it and obtain professional advice when appropriate.

5. AI-generated and third-party output

AI systems may create inaccurate, incomplete, unexpected, offensive, or similar output for different users. You use generated output at your own risk. Features supplied by AI, stock-media, voice, payment, hosting, or other providers may also be subject to their terms and licenses. Access through FuxionVideo does not grant rights beyond the applicable provider license.

You may not remove watermarks, attribution, provenance signals, or rights-management information unless the applicable license expressly permits it.

6. Prohibited use

You may not use the service for unlawful, fraudulent, deceptive, defamatory, harassing, hateful, exploitative, sexually abusive, or privacy-invasive material; unauthorized impersonation or deceptive synthetic media; malware; infringement; circumvention of security, billing, moderation, or usage controls; or any activity that could harm another person, the service, or its providers.

7. Moderation and copyright reports

We may investigate, restrict, remove, or disable content and suspend or terminate accounts when we reasonably believe these Terms, provider rules, or applicable law have been violated. Copyright or rights complaints should be sent through our protected contact: Show protected email, with the claimant’s contact information, identification of the protected work, the disputed material and its location, a good-faith statement, and evidence of authority to act.

8. Credits, subscriptions, payments, and refunds

Prices and included usage are shown before purchase. Payments are processed by PayPal and are also subject to PayPal’s terms. Subscriptions renew until cancelled. Cancellation prevents future renewal but does not retroactively reverse completed billing periods. Credits have no cash value, are not transferable, and are governed by the plan or package shown at purchase. Payments are non-refundable except where required by law or expressly stated at checkout.

9. Availability and storage

The service is provided on an “as is” and “as available” basis. We do not promise uninterrupted operation, permanent storage, error-free output, or compatibility with every format or platform. Keep independent copies of important source material and exported videos.

10. Disclaimer and limitation of liability

To the maximum extent permitted by applicable law, AlienCat Software and its providers disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. To that same extent, they will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, reputation, or business; or claims arising from User Content, generated output, third-party services, or your publication and use of content.

To the maximum extent permitted by law, total aggregate liability arising from the service will not exceed the amount you paid to FuxionVideo during the twelve months preceding the event giving rise to the claim. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded.

11. Indemnity

To the extent permitted by law, you agree to defend and indemnify AlienCat Software and its providers against third-party claims, damages, and reasonable costs resulting from your User Content, your output, your use or publication of content, or your violation of these Terms or another person’s rights.

12. Suspension and termination

You may stop using the service at any time. We may suspend or terminate access for non-payment, security risk, abuse, legal requirements, or violation of these Terms. Before termination, export any content you need where the service provides that capability.

13. Changes

We may update these Terms. Material changes will be posted through the service or communicated to the account email when appropriate. Continued use after the effective date of revised Terms constitutes acceptance, subject to applicable law.

14. Governing law and contact

These Terms are governed by the laws of Costa Rica, without limiting mandatory consumer protections that apply to you. Disputes will be submitted to the competent courts of Costa Rica unless applicable law requires otherwise.
